Dialynx ("Dialynx," "we," "us," or "our") provides an AI-powered inbound and outbound voice calling platform that helps businesses answer, qualify, and act on phone calls automatically (the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our website, dashboard, and Service, including when our Service places or receives calls or messages on your behalf.
By using the Service, you agree to the collection and use of information as described in this policy.
1. Information We Collect
Account & Business Information. Name, email, phone number, company name, billing information, and login credentials when you create an account.
Call & Communication Data. When you use Dialynx to handle inbound or outbound calls, we process:
- Caller and recipient phone numbers
- Call recordings and audio (where enabled and consented to)
- Call transcripts and AI-generated summaries
- Call metadata (duration, timestamp, disposition, outcome, sentiment)
- SMS/text message content and metadata, where messaging features are used
CRM & Integration Data. When you connect Dialynx to HubSpot, Zoho CRM, Salesforce, or other third-party tools, we access and sync contact records, deal/lead data, call logs, and activity notes necessary to provide the integration, as authorized by your connection settings and the permissions you grant via OAuth.
Usage & Device Data. IP address, browser type, device identifiers, log data, and analytics collected via cookies and similar technologies on our website and dashboard.
Payment Information. Billing details are processed by our third-party payment processor; Dialynx does not store full payment card numbers.
2. How We Use Information
We use collected information to:
- Provide, operate, and improve the Service, including routing calls, generating AI responses, and syncing data to your connected CRM
- Authenticate and manage your account
- Process billing and payments
- Provide customer support
- Monitor for fraud, abuse, and violations of our Terms & Conditions
- Comply with legal obligations, including telecom carrier and regulatory requirements
- Send you service-related notifications (not marketing, unless separately opted in)
3. Calling & Messaging Consent (10DLC / TCPA Compliance)
Dialynx uses Twilio and other telecom carriers to deliver calling and messaging functionality on behalf of our customers. As required by carrier and A2P 10DLC campaign policies:
- No mobile information or call data collected through consent workflows will be shared with third parties or affiliates for marketing or promotional purposes. Any sharing with subprocessors is limited to what is necessary to operate the Service (see Section 6).
- Customers using Dialynx to place outbound calls or texts are solely responsible for obtaining and documenting valid prior consent from call/text recipients in accordance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, CTIA Messaging Principles, and applicable state and carrier requirements.
- Recipients of SMS communications sent through the Service may reply STOP to opt out at any time and HELP for assistance. Message and data rates may apply. Message frequency varies based on your account's configured campaigns.
- Dialynx maintains opt-out and consent records passed to us by customers to support compliant delivery, and honors STOP/opt-out requests at the platform level.
- Call recipients may be informed, where required by law, that they are speaking with an automated/AI voice agent (see also Section 4 and our Terms & Conditions, "AI Disclosure").
4. Call Recording Disclosure
Where call recording is enabled on an account, Dialynx and its customers are responsible for complying with applicable federal and state call-recording consent laws, including one-party and two-party (all-party) consent state requirements. Dialynx provides configurable recording-disclosure prompts, but the customer configuring the agent is responsible for enabling and using them appropriately for the jurisdictions they operate in.
5. Data Sharing & Subprocessors
We share information with the following categories of subprocessors, only as needed to deliver the Service:
- Telecom & Messaging Providers (e.g., Twilio) — to place/receive calls and texts
- AI/LLM and Voice Providers (e.g., speech-to-text, text-to-speech, and language model providers) — to generate conversational responses
- CRM Platforms (HubSpot, Zoho, Salesforce) — only the data you authorize to sync via your own connected account
- Cloud Hosting & Infrastructure Providers — to store and process data securely
- Payment Processors — to process billing
We do not sell personal information. We do not share call or messaging opt-in data with third parties for their own marketing purposes.
6. Data Retention
We retain call recordings, transcripts, and related data for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your data subject to Section 8 and any regulatory retention requirements (e.g., carrier or financial recordkeeping rules).
7. Data Security
We implement administrative, technical, and physical safeguards designed to protect data, including encryption in transit, access controls, and audit logging. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Your Privacy Rights
Depending on your location, you may have the right to access, correct, delete, or port your personal information, and to opt out of certain processing. California residents have rights under the CCPA/CPRA, including the right to know, delete, and opt out of "sale" or "sharing" of personal information — Dialynx does not sell or share personal information as defined under CCPA. EEA/UK residents have rights under GDPR, including a legal basis for processing and the right to lodge a complaint with a supervisory authority. 9. Children's Privacy
The Service is not directed to individuals under 18. We do not knowingly collect personal information from children.
10. International Data Transfers
If you access the Service from outside the country where our servers are located, your information may be transferred internationally. We take steps to ensure appropriate safeguards are in place for such transfers.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated effective date.
